Abstract

The habeas corpus aims, directly or indirectly, at the patient’s freedom of physical movement, a legal good that must be the most strongly protected by a constitutional action. Based on this established premise, this article aims to analyze the (im)possibility of the accusatory body filing a special and/or extraordinary appeal in the face of a concessive decision of the writ, based on three essential foundations: instrument aimed at the exclusive defense against violation of rights of people investigated and/or criminally accused, lack of Constitutional provision, and attributions of the accusatory body.
