This article discuss the legislative amendment “Anticrime Package”, focusing on changes about recidivism and criminal habituality. It seeks to assess how the different treatment of these topics can influence the Brazilian penal system, considering the negative effects that state punishment has on penalized citizens, as well as the technical flaws presented by both the bill and the studied legal concepts.
