Abstract

This article is intended to analyze the practical difficulties that affect the effectiveness of the initial hearing idealized in the way currently outlined in the international human rights documents and by the National Council of Justice (CNJ) Resolution 213/2015, which initial hearing proceeding within the scope of the Judiciary. The critical study of the way in which initial hearings are conducted on certain occasions exudes from the day-to-day perception of forensics, which betrays relevant normatization through questionable practices from the perspective of enforcing fundamental rights and guarantees.
