The judicial precedents in criminal cases did not receive due attention from Brazilian doctrine. However we should talk about the implications of precedents in criminal procedure as the supposed violation of fundamental rights and individual guarantees in criminal trials. There are many criminal principles and important features that preclude uncritical adoption from civil procedure to criminal procedure. This article concerns issues of relevant judicial practices to contribute to the development of the research.
