This article aims to establish a connection between the colonial matrices experienced in Brazil and its current position in relation to the hegemonic North American criminal policy, analyzing the proposal for the implementation of criminal justice negotiated in Brazil, and addressing how Brazil does not observe the best examples and epistemological studies on the application of criminal procedural law in legal systems.
