The text analyzes the importance of internalizing international human rights treaties in Brazil, highlighting advances such as the control of conventionality exercised by national judges. The author reflects on the relevance of the case Cabrera Garcia and Montiel Flores v. Mexico, judged by the Inter-American Court, which reinforces pre-trial guarantees, prohibits the use of evidence obtained through coercion, and limits the use of the Armed Forces in public security. The decision strengthens the protection of fundamental rights and serves as a critical tool to resist the structural violence of the Latin American criminal justice system.
