Por que e como se tornar um personagem estatal Juiz Transgressor na modernidade tardia

Resumo

Agentes de Estado não são somente personagens jurídicos, despersonalizados e voltados ao cumprimento da lei abstrata em um dado território nacional e situados no palco do Direito moderno, mas também agentes culturais ou produtos carregados e tensionados por um conjunto de práticas culturais ao redor da transgressão. Nesse sentido, o presente trabalho busca reimaginar a figura do magistrado (lato sensu), enquanto um personagem, sujeito e parte da sociedade tardo-moderna, o qual procura se atualizar diante das contradições culturais e dos dilemas deixados entre a modernidade e a pós-modernidade no presente através dessas racionalizações ou práticas ao redor da transgressão, em vez do crime. Assim, com base no método de revisão bibliográfica e de estudos revitalizados pela Criminologia Cultural (do Estado), nossa proposta de pesquisa reflete sobre a seguinte questão, por que e como o performante estatal juiz decide se tornar um personagem transgressor na modernidade tardia. Para tanto, propomos a análise acerca da prática cultural de ação-limítrofe e anárquica em volta da transgressão e intermediada pelo ator público magistrado, bem como as razões pelas quais optamos pelo emprego do termo transgressão, no lugar de crime de Estado.
