The paper stands for a conception of penal execution founded in its roots on the Numerus Clausus principle, which proposes incarceration must not exceed the number of available accomodations in any prison facility. The principle of Numerus Clausus is presented and its main dogmatic characteristics are delineated and put in context to present times, supporting its structural recognition on penal execution law.
