Abstract

This paper examines Article 28-A, §14, of the Brazilian Code of Criminal Procedure, which mandates that, when a non-prosecution agreement (ANPP) is declined, the case records must be submitted to the internal review body of the Public Prosecutor’s Office. It argues that this provision embodies a rule of public order that safeguards due process, judicial impartiality, and the separation of functions inherent in the accusatorial system. Although the defendant has no subjective right to the agreement itself, they are entitled to a reasoned prosecutorial decision, the review of which lies exclusively within the institutional sphere of the Public Prosecutor’s Office. Jurisprudence from the Federal Supreme Court and the Superior Court of Justice confirms that a judicial refusal to forward the records for supervisory review constitutes undue interference with prosecutorial functions and violates the Constitution.
