The paper analysis the standards brought by the jurisprudence of the Interamerican Court of Human Rights in the Case Jesús Vélez Loor vs Panama, concerning the protection of irregular migrant’s rights in the situation of arbitrary detention in the country of destination. This piece verifies how this jurisprudence can become an instrument to protect the human rights of persons in prisons, being nationals or immigrants.
