The paper aims to discuss methodological issues related to the comparative study of the american plea bargaining. To achieve this goal, two useful comparative approaches will be presented: Damaška's macro-comparative approach, which focuses on the relationship between criminal procedure and the way political power is exercised and Van Hoecke's deep level micro-comparative approach, wich includes the deeper level of underlying theories and conceptions in the comparative law research. The paper will show that the use of the appropriate method is fundamental to avoid misunderstandings and to ensure that comparative research of plea baragaining contributes to discussions on the consensual criminal justice system in Brazil.
