Abstract

This essay deals with the relationship between empathy and criminal law, proposing a first approach to recent evidence reported by neurosciences. Traditionally foreign to criminal law, the concept of empathy has been gaining new life in the field of cognitive social neuroscience, from the monitoring of brain activity through functional magnetic resonance scanners - fMRI Scanners. It seeks to understand the impact of these studies in the context of criminal law, both from the perspective of the positive verification of the empathic phenomenon, and regarding the modulation of the empathic response.
