The criminal procedural procedure as the last standard of objective construction of the crime

The reconstruction of facts through the process, in this case, the criminal process, is an epistemological process. It is this epistemological process, governed by a procedure, that will lead to the reconstruction of facts, which in turn will seek to represent what has already happened. In this sense, the crime, in a material way, only comes into existence after the final criminal sentence. What seems merely theoretical has relevance in the practical field, from the interaction of sanctioning administrative processes to the fundamental processes of precautionary arrests. It is in this sense that the debate in this article arises.
