The main objective of this article is to critically analyze the imposition of a contempt fine for filing a Regimental Appeal in an Extraordinary Appeal with the Federal Supreme Court when considered manifestly inadmissible or unanimously dismissed. The problem is to identify whether this type of measure brings negative consequences for the exercise of broad defense, one of the pillars of the criminal process. As a hypothesis, the imposition of the fine inhibits the exercise of broad defense, damaging the accusatory structure of the criminal process. Finally, the method used is qualitative, supported by literature review.
