Resumo

O presente artigo procura investigar a emergência do sistema de plea-bargaining e os seus impactos na administração da justiça criminal. Além disso examina como argumentos econômicos são usados na legitimação da negociação no processo penal e os resultados nucleares deste fenômeno. O plea-bargaining é também compreendido como uma ferramenta neoliberal capaz de minar o tradicional processo criminal adjudicativo, gerando o que poderia ser denominado como gestão administrativa de sanções criminais. Finalmente, após considerar este cenário mais amplo, o artigo demonstra o impacto e o quão próximo os acordos de não persecução penal estão da racionalidade neoliberal e seus efeitos difusos no incremento da forma gerencialista do processo penal.
