The Jury Court weakened by the decisions of the Supreme Court of Brazil

By analyzing the most recent case law of the Supreme Court of Brazil on the Jury Court from a qualitative perspective, it is perceptible that there is a relativization of certain constitutional norms and individual rights. From this analysis, the following question arises: How can a guarantee be examined against the defendant? This article examines the implications of the Supreme Federal Court’s decision on the immediate execution of sentences in Jury Court convictions, established by the “Anticrime Package” (Law 13,964/2019) and later modified by the Court in Extraordinary Appeal 1,235,340. The decision, which allowed the immediate execution of any Jury Court conviction, regardless of the sentence, breaks with the principle of the presumption of innocence, contradicting precedents of the Court.
