This article examines Dario Ippolito’s essay on Montesquieu, identifying seven roots of penal guaranteeism in Enlightenment thought, particularly in The Spirit of the Laws. Through a historiographic and theoretical approach, Ferrajoli highlights how concepts such as legality, precision, materiality, offensiveness, mitigation of punishments, separation of powers, and judicial independence form the backbone of guaranteeism. The article also reflects on the contemporary relevance of these ideas in light of the current crisis of the Rule of Law and the rise of autocratic regimes. It calls for a critical and propositional re-reading of classical texts in defense of fundamental freedoms.
