The criminal fine, as provided for in the Brazilian legal framework, has assumed a central role in debates on its enforceability and practical effects, particularly when applied to convicted individuals in situations of socioeconomic hardship. The amendments introduced by the Superior Courts decisions and Law 13,964/2019 (Anticrime Package) altered the rules governing the enforcement of fines, expanding their impact on this population by prolonging the effects of criminal conviction and hindering social reintegration. This article undertakes a critical analysis of recent legislative and jurisprudential developments, with an emphasis on case law from the São Paulo Court of Justice, seeking to identify progress, setbacks, and institutional barriers surrounding the issue of criminal fines. The research highlights the urgency of reforms that incorporate the assessment of socioeconomic vulnerability as a central criterion for ensuring the rights of individuals affected by the penal system.
