Tougher penalties in the anti-crime bill
an innocuous path

This article analyses, considering a critical perspective, the Federal Government Anticrime Project, presented in February 2019, taking account the harsh criminal punishment law proposed. Introductory, the paper talks about the law proposed changes for, through the comparative method, do an analytic collation between the Project and the criminal politics speech assumed by it, making a parallel with the theory of criminal prevention in its many facets. Based on national and international doctrine, this work argues that more austere penalties adoption and more incisive forms of execution don’t imply, necessarily, the non-occurrence of crimes and, therefore, don’t revel, in any of its theoretical aspects, prevention. That fact, de-legitimize the adoption of these measures in Brazilian legal system, which put penalty like legal good guarantee.
