Constitution and life imprisonment
notes on Article 77 of the Rome Statute

This passage presents a highly complex legal problem, as it pits the life sentence provided for in the Rome Statute (Article 77) against the Brazilian constitutional prohibition (CRFB, Article 5, XLVII, “b”). It should be noted that, even though Brazil has made international commitments by ratifying the Statute, it cannot internally admit sanctions that are incompatible with constitutional provisions. Three possible paths are therefore proposed: withdrawal from the Statute, imposition of a normative reservation so that the ICC does not impose life imprisonment for crimes committed in Brazil, or dealing with cases under the jurisdiction of the ICC through the domestic judicial system, acting under the principle of complementarity.
