“Anti-Crime Bill” and the recognition of justifications by the police chief

Abstract

The article examines the proposal of Bill 882/2019 (“Anti-Crime Package”) which aims to insert Article 309-A into the Code of Criminal Procedure. This provision would grant the Police Chief the power, when finding clear evidence of justifying causes (such as state of necessity, self-defense, legal duty, or regular exercise of rights) in the flagrante delicto phase, not to make an arrest, provided that a commitment to appear at procedural acts is recorded and the investigation is continued. The purpose of this mechanism is to reinforce the filter of legality already in place at the police authority, avoiding undue fines and arrests, as well as making the guarantee of fundamental rights more effective in the initial phase. The text addresses the challenges of implementation, the risk of trivializing arrest, the constitutional adequacy of the role of the police chief, and its repercussions for public safety and the effectiveness of procedural guarantees.
