Abstract

This article seeks to analyze how current criminal policy is aligned with penal populism. For this, it starts from theoretical concepts that perceive the phenomenon of penal populism as a technique of expansion of criminal law from the management of the feeling of insecurity and fear and clamors for more punishment. From there, it is defended the adoption of rational criteria for the definition of an (other) criminal policy, which has as a starting point debates, investigations and in-depth technical studies.
