Technological dependence, cyberbullying and social control

A critical analysis of digital regulation and the inadequacy of the criminal response

Abstract

The article investigates the technological dependence of children and adolescents and its legal and social impacts, with a focus on cyberbullying and youth violence associated with the use of electronic devices and social media. It seeks to answer the question: how can the official control system deal with the challenges arising from the technological dependence of children and adolescents in the face of offenses associated with the use of electronic devices and social media? It is justified by the need to assess the effectiveness of current regulations and propose alternatives that prioritize digital education and informal social control. Using a qualitative methodology and a hypothetical-deductive approach, it is based on documentary analysis and a bibliographic review of national and international legislation. It is based on the hypothesis that the lack of effective regulation intensifies social conflicts and violent behavior, with digital education being more effective than repressive measures. The results indicate that early and excessive exposure to screens compromises psychosocial development, aggravating aggression, isolation, anxiety and depression. The analysis of Art. 146-A of the Penal Code shows normative weaknesses and penal symbolism, reinforcing the need for public policies aimed at digital education. The conclusion is that the regulation of technology should prioritize informal social control and digital awareness, promoting more effective solutions than simply criminalizing conduct.
