Abstract

The text examines the current problems of the doctrine of criminal guilt, reaffirming the principle of guilt as a limitation on state power and intervention and as a requirement of respect for personal dignity. It analyses the material content of guilt, the relationship between freedom and responsibility, the distinction between types of unlawfulness and types of guilt, as well as the relations between intent, negligence and mistake. It also examines the grounds excluding guilt, particularly unenforceability, and critically discusses the category of responsibility for the act, confronting Maurach’s and Roxin’s approaches with the author’s conception of guilt.
