Abstract

Crime exists and, since its elimination is impossible, the State, as holder of the right to punish, must repress and prevent it. Although necessary, punishment is harmful in the forms and institutions in which it is applied, making it necessary to restrict deprivation of liberty and use alternative penalties and penal substitutes. Security measures, which have a nature different from penalties, constitute an instrument directed toward prevention and the future. The author presents their historical evolution and examines their regulation in comparative law, especially in Italy, Germany, Belgium, Denmark, France, England, Portugal and Brazil. He concludes that, when properly used, they represent an effective form of crime prevention.
