Abstract

The text examines Law 8.701/93, which added § 2 to article 370 of the Code of Criminal Procedure, allowing summonses through simple publication of acts in the official gazette. It analyzes the material constitutionality of the provision, comparing it with the guarantees of due process, adversarial proceedings, full defense and the principle of procedural equality, concluding that the restriction on procedural information is unconstitutional. It also examines the relationship between the new paragraph and § 5 of article 5 of Law 1.060/50, which ensures personal summons to the Public Defender, concluding that the latter was not repealed, as it constitutes a special law. It concludes that the requirement of personal summons for Public Defenders remains in force.
