Abstract

The article examines community service, introduced by the 1984 Penal Reform as an alternative to imprisonment for short sentences. It analyzes the legal requirements (art. 44 of the Penal Code), the objective and subjective conditions for substitution, the prison crisis, and the institute in comparative law (England, France, Italy, Poland). It concludes that the measure, by not segregating the convict and imposing unpaid work in charitable institutions according to his abilities, serves resocialization without the criminogenic effects of prison, though its effectiveness depends on social engagement and adequate infrastructure.
