Abstract

The text examines the impunity of macro-economic crime from the criminological perspective of learning theory, enumerating factors that favor it, such as organizational complexity, anonymity between offender and victim, weak social reaction, the offender's favorable image, and deficient legal regulation. It analyzes techniques of neutralization and justification, the ineffectiveness and delegitimization of the criminal system, selectivity and the dark figure of crime, highlighting the labeling approach theory. It proposes, for the criminal control of macro-criminality, disregarding the devaluation of the offender's social status, the critical revision of the societas delinquere non potest principle, and the redimensioning of the state response, concluding with the need for a preventive and socially useful Criminal Law.
