Abstract

The text examines the history of Brazilian penal legislation in the republican periods, from the 1890 Criminal Code to the 1940 Criminal Code. It analyzes the Republican Code, its list of custodial penalties and the influence of the Positive School, as well as the reform projects of Vieira de Araújo, Galdino de Siqueira, and Virgílio de Sá Pereira. It examines the Consolidation of Penal Laws, the 1934 Constitution, the 1935 Project, and the Estado Novo coup, with the 1937 Constitution and the Alcântara Machado Draft. It analyzes the 1940 Criminal Code, its list of penalties and security measures, the double-track system, and the marginalization of criminology, concluding with the dehumanization of the system and the neglect of penal execution.
