Abstract

The text examines the distinction between the organized crime entity and the organized practice of crimes, characterizing the former by its institutionalization around a hierarchical and disciplined center of power, with a global strategy, transnationalization, use of violence, corruption of public officials and money laundering. It then analyzes golden criminality practiced by large conglomerates that, although lawfully constituted, rely on their institutional structure, their economic and political power and specialized professionals to offend the economic order and the Public Administration. It concludes by proposing, as a normative response, the temporary interdiction of the exercise of a management position or function for those convicted of crimes committed through a company.
