Abstract

The text examines traffic accident prevention, analyzing the bill under consideration in the Federal Senate that toughens fines and criminalizes dangerous conduct. It criticizes the criminalization of traffic contraventions and infractions, arguing that there is only one firm way to reduce accident statistics: the imposition of high administrative fines, regardless of injury to life or physical integrity. It analyzes the failure of legislation, the toughening of punishment and the rationalization of the system, concluding with the simplicity of realistic legislation, which dispenses with the Judiciary in mere dangerous conduct and reserves criminal proceedings for cases of concrete damage.
