Abstract

The text deals with the criminal protection of the environment in French law, starting from the 1977 resolution of the European Council on Environmental Law, which considers the environment a fundamental value like life or property, and showing how France equipped itself with legislation to regulate disturbing human activities and repress attacks on the elements of the environment, under pressure from international and community law and public opinion. The exposition describes the imposing and complex criminal order, marked by the multiplicity of incriminations, incoherence of sanctions and particularisms unfavourable to environmental offenders, and concludes with the random efficacy of environmental criminal law, due to the rarity of prosecutions and the mildness of sanctions.
