Abstract

The text deals with the criminal irresponsibility of the adolescent, examining the positions on the age limit provided for in the Constitution and its possible reduction, and arguing that the vision of destabilising hordes constitutes an interpretative mistake and a cynical argument of a society emptied of its ethical principles. The exposition analyses the scientific autonomy of juvenile law, the principle of the minor's well-being, the infractional act as a legal euphemism for crime and the socio-educational measure as a heterogeneous afflictive sanction of a criminal nature. The investigation concludes that infractional act and crime, as well as penalty and socio-educational measure, are in essence the same thing, differing only in language, which performs the function of recognising the constitutionality of the Statute.
