Abstract

The article analyzes the political approach given to criminal issues in the United States and its consequences for the criminal justice system. The exposition starts from alarming incarceration statistics, which place the country with the highest imprisonment rate in the world, and examines the failure of the War on Drugs, the rise in violent crime and the budgetary costs of prisons. The investigation demonstrates that politicians and policymakers have chosen punitive measures to win votes, to the detriment of preventive programs. The text concludes that the depoliticization of criminal issues is a necessary condition for lasting and rational solutions.
