The article examines the conflict between freedom of the press and the criminal protection of privacy in the Portuguese legal experience. The exposition starts from the characterization of privacy as a legal interest of social vinculum and immanent collision of values, analyzing the dual dimension, individual and institutional, of freedom of the press and the principles of reciprocal effect and irradiation of fundamental rights. The investigation examines privacy and intimacy as an autonomous legal interest in relation to honor, with support from the three-degree theory, and analyzes typicity and unlawfulness, with emphasis on the pursuit of legitimate interests. The text concludes by the reinforced fragmentariness of criminal protection.
