Abstract

The article examines the circumstances of Carlos Marighella's death and the responsibility of the State, within the scope of the Special Commission created by Law 9,140/95. The exposition starts from the controversy between the official version, according to which the ALN leader died in armed confrontation, and the applicants' thesis of deliberate execution under the control of public agents. The investigation sustains the broad interpretation of article 4, I, b, which encompasses those who died under State custody, and analyzes the DOPS report, the expert reports and the medico-legal opinion, which points to a fatal shot at very close range. The text concludes by the inexistence of just cause for the execution and by the recognition of the name.
