Abstract

The article examines the filing of a writ of mandamus by the Public Prosecution Service to obtain suspensive effect in an interlocutory appeal filed against a decision that granted provisional release. The exposition recognizes the legitimacy of the prosecution service and analyzes the conditions of the action, especially the legal possibility of the request. The investigation sustains that the request is unconstitutional, since article 581, V, of the Criminal Procedure Code does not attribute suspensive effect to the appeal, and the intended granting would offend the fundamental right of liberty. The text concludes by the non-knowledge of the writ, with support from Ferrajoli's guarantor model and the principle of proportionality.
