Abstract

The article examines the issue of abortion as a public controversy marked by philosophical, ethical, political, religious, and cultural divergences, which constitute a différend, a dispute without permanent resolution. The exposition analyzes the criminalization that affects mostly poor and black women, the relationship between the State and the female condition, and the difficulty of proving authorship and materiality of the crime. The text examines criminal abortion proceedings, the valuation of the forensic examination, and the intimate dispositions of judges. The investigation concludes that the illegality of abortion has lost support and that women should be treated as full-bodied citizens.
