Abstract

The article examines the contradiction between the normative discourse of respect for human dignity and the practice of the Brazilian penal system, taking the Carandiru massacre as a paradigm. The methodology used is the theoretical-critical analysis grounded in Miguel Reale's three-dimensional theory of Law and Celso Lafer's reconstruction of human rights. The exposition covers the dimensions of fact, norm and value, verifying that protective norms are formally valid but ineffective in penal execution. The investigation concludes that the exemplarity of Carandiru leads to bi-reflexive action, proposing the assumption of the penitentiary issue by society, concrete citizenship and human rights education.
