Abstract

The article examines the contribution of criminal procedure culture to the drafting of the Italian Code of Criminal Procedure of 1988. The methodology used is historical-sociological research, with analysis of the legislative process, the actors and the institutes of the new code. The exposition reconstructs the jurists' primacy in the ministerial commissions, the dynamics with magistrates and ministerial bodies, the definition of the accusatory model and the institutes they conceived, such as the law of criminal evidence. The investigation concludes that the professors' culture won in the drafting of the norms, but was defeated in the system's operation, by the reaction of the magistracy and the Constitutional Court.
