Abstract

The article examines the jurisprudence of the Italian Constitutional Court regarding personal freedom and procedural precautionary measures. The methodology used is the historical-jurisprudential analysis of the Court's decisions, from 1956 to 1996, in confrontation with doctrine and the legislator. The exposition covers the notion of personal freedom, the purposes of precautionary custody, the presumption of innocence and the right of defense, verifying the underestimation of art. 27, § 2, of the Constitution. The investigation concludes that the Court adheres to the code's lines and procedural requirements, but the central problem remains the excessive duration of proceedings.
