Abstract

The article examines the developments and trends of German criminal policy regarding drug control, especially from the debates of the 1980s. The methodology used is the historical-critical and jurisprudential analysis of legislation, doctrine and decisions of the German Constitutional Court. The exposition covers repression of consumers and drug addicts, investigative techniques, organized crime, money laundering and the cannabis decision. The investigation concludes that the control system differentiates into cannabis, heroin and cocaine, with a tendency to replace penal control with civil and administrative control.
