Abstract

The article presents an opinion of the Public Prosecution Service and a sentence on the application of Law 9,714/98 to a person convicted of drug trafficking. The methodology used is the dogmatic and jurisprudential analysis of legislation, the principle of specialty and court precedents. The exposition examines the incompatibility between Law 8,072/90 and the substitution of the penalty, the requirements of art. 44 of the Criminal Code and the jurisdiction of the execution court. The investigation concludes by the possibility of substituting imprisonment for restrictive penalties of rights for the convict who meets the legal requirements.
