Abstract

The article seeks, from the perspective of legal sociology, to shed light on one of the paradoxes constitutive of the formulation of crime-fighting policy in the contemporary world. On the one hand, over the last decades, especially in advanced capitalist societies, there has been an exponential increase in imprisonment rates and the intensive use of the penitentiary as a privileged strategy for controlling violence. On the other hand, there is a growing social perception, especially in academic circles, that the custodial sentence has not been able to fulfill, with a minimum of efficiency, its promises. The analysis of the new wave of incarceration proceeds through the attempt to identify structural links between the reorientation of the criminal justice system and the social transformations engendered by the globalization of capitalism.
