This article aims to research the study about the acquisition of computer data from the extraction perpetrated in criminal prosecution, from the apprehension of computer devices. This is a subject of contemporary discussion in the brazilian Superior Courts. Thus, the judgment of the AgRg in the Appeal in Habeas Corpus nº 143.169 – RJ (2021/0057395-6) - STJ will be analyzed, and based on this precedent, other discussions pertinent to the subject will be proposed, such as the execution of concrete court orders, the guidelines established by Digital Forensic Science and the observance of Discovery as an institute capable of providing greater reliability in the extraction of data by software for investigative use. The case study is, therefore, the methodology used whose analysis is also complemented by the bibliographical and documentary review.
