Abstract

The legal opinion by José Afonso da Silva, requested by the OAB President, analyzes Direct Action of Unconstitutionality No. 1,127-8, filed by the Brazilian Magistrates Association against provisions of the Attorneys' Statute (Law 8,906/94). The author concludes that AMB lacks standing, as the STF has already held that an association of associations does not have standing for ADIn, and that there is no thematic relevance, since the challenged norms do not affect the rights or interests of magistrates as a category. On the merits, he rejects all unconstitutionality claims, arguing that the provisions are in line with art. 133 of the CF (indispensability and inviolability of lawyers) and with the guarantees of due process, adversarial proceedings and full defense.
