Abstract

The text deals with criminal law as an instrument to inhibit violence, starting from an initial approach to violence, which may be physical or moral, perpetrated by a natural person or by moral entities, including public ones, considering illegitimate violence. The exposition examines the decriminalization of conducts that do not deserve severe social rejection, macro-delinquency, marked by sophistication, technological mastery and the difficulty of typical subsumption, and the delay of criminal proceedings and other similar violence, especially against the poor defendant. The investigation concludes that the presence of criminal law must be restricted to fields where the protection offered by other segments of criminal science has not been sufficient, and that decriminalization is one of the steps to restore its efficacy, with special criminal courts being responsible for relieving conventional courts.
