Abstract

The article comments on a Supreme Federal Court judgment that denied a habeas corpus petition in favor of a Mayor accused of injury against his predecessor, committed through the press. The exposition examines the summary, the report, the rapporteur's vote and the opinion of the Federal Public Prosecution Service, discussing the public man's zone of illuminability, freedom of criticism, the animus injuriandi and the lack of just cause. The investigation adopts the methodology of jurisprudential and doctrinal analysis. The text argues that tolerance for criticism is lesser when the libel goes beyond disparaging judgments to impute facts that border on criminality and concludes by denying the order.
