Abstract

The aim of the article is to draw attention to a social problem practically ignored by national academic literature, by professionals in the field and by the general population: the implications of maternal imprisonment on the lives of children. The exposition adopts the methodology contained in the text, based on a literature review and analysis of data from prison censuses and reports by national and international organizations. The investigation is divided into two parts: the first discusses the national panorama, focusing on the incarcerated population, legislation on the subject, motherhood and pregnancy in the prison context, the maintenance of bonds between imprisoned mothers and their children and the possibilities of custody of the children; the second describes and contextualizes the experiences discussed by international literature, evidencing a reflection on the theme that, although insufficient, is more advanced than that of the Brazilian reality. The text concludes by highlighting that maternal imprisonment does not deprive of liberty only the woman who committed the punishable act, but punishes her entire web of social relations, including her children, who, being innocent, end up being heavily penalized.
