Abstract

The article proposes a critical-methodological view of criminal law, opposed to the dogmatic perspective that identifies law, legal right and justice. It argues that crime and punishment possess neither logical-objective structures nor a universal legal essence, but are historically constructed through the interaction of law, ideology and the interpreter. The will, freedom and power of those involved in the making and application of law therefore assume a decisive role. It consequently advocates a methodology of criminal-law teaching capable of revealing its historical and sociological dimension and the ethical responsibility of its agents in the concrete construction of punitive legality.
